Art. 1 - General Provisions

  1. By browsing this area, the user accesses OPTICAL LUCCA, available at the URL:
    https://www.opticallucca.com. Browsing the site and submitting a purchase order implies acceptance of the Terms and Data Protection Policies adopted by the site as stated herein.

  2. These General Terms and Conditions of Sale apply exclusively to the sale of products purchased on the website, in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree No. 206/05, as amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by:

  1. Before accessing the products provided by the site, the user is required to read these General Terms and Conditions of Sale, which are considered fully and unequivocally accepted upon purchase.

  2. Users are invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which OPTICAL LUCCA reserves the right to amend unilaterally and without prior notice.

Art. 2 - Purpose

  1. These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on OPTICAL LUCCA and do not regulate the provision of services or the sale of products by parties other than the seller, which may be present on the same site via links, banners, or other hypertext connections.

  2. Before placing orders and purchasing products and services from parties other than the seller, we suggest checking their own sales conditions.

Art. 3 - Conclusion of the Contract

  1. To finalize the purchase contract, the electronic form must be completed and submitted by following the relevant instructions.

  2. The form includes a reference to the General Terms and Conditions of Sale, images of each product and its price, the available payment methods, the delivery methods for the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and the methods and timing for returning purchased products.

  3. Before concluding the contract, the user will be asked to confirm that they have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and personal data processing.

  4. The contract is concluded when the seller receives the completed form from the user, after verifying the accuracy of the data therein.

  5. The user will be obliged to pay the price from the moment the online order submission process is completed. This is done by clicking the "Buy" button at the end of the guided procedure.

  6. Once the contract is concluded, the seller will process the order.

Art. 4 - Registered Users

  1. When completing the registration procedures, the user agrees to follow the instructions on the site and to provide accurate and truthful personal data.

  2. Confirmation of registration exempts OPTICAL LUCCA from any responsibility regarding the data provided by the user. The user agrees to promptly inform OPTICAL LUCCA of any changes to the data provided at any time.

  3. If the user provides incorrect or incomplete data, or if there are disputes regarding payments made, OPTICAL LUCCA reserves the right to not activate or to suspend the service until the issues are resolved.

  4. Upon the first request to activate a profile, OPTICAL LUCCA will assign a username and password to the user. The user acknowledges that these identifiers constitute the validation system for access to services and the only method for user identification. Actions performed through this access will be attributed to the user and will be legally binding.

  5. The user agrees to keep access credentials confidential and to guard them with due care and diligence, and not to share them even temporarily with third parties.

Art. 5 - Product Availability

  1. Product availability refers to the actual availability at the time the order is placed. However, such availability should be considered indicative, as multiple users may be accessing the site simultaneously and products could be sold to other customers before order confirmation.

  2. Even after the order confirmation email has been sent, there may be cases of partial or total product unavailability. In this event, the order will be automatically adjusted with the removal of the unavailable product and the user will be promptly notified via email.

  3. If the user requests the cancellation of the order, thereby terminating the contract, OPTICAL LUCCA will refund the amount paid within 14 days from the time it became aware of the buyer's decision to terminate the contract.

Art. 7 - Payment Methods and Prices

  1. The price of the products will be as indicated on the website at the time, except in cases of obvious error.

  2. In case of an error, OPTICAL LUCCA will notify the buyer as soon as possible, allowing them to confirm the order at the correct price or cancel it. In any case, OPTICAL LUCCA is not obligated to supply the product at the incorrectly stated lower price.

  3. The prices of the eyewear do not include shipping costs. Prices may change at any time, but such changes do not affect orders already confirmed.

  4. Once the desired products are selected, they will be added to the cart. Users must follow the purchase instructions, entering or verifying the required information at each step. Order details can be modified before payment.

  5. Payment can be made via:

Art. 8 - Delivery

  1. OPTICAL LUCCA ships throughout Italy and Europe using GLS courier (including non-EU countries).

  2. OPTICAL LUCCA delivers only to the address provided by the user at the time of purchase.

  3. Delivery is usually made within 2–4 business days, or, if no delivery date is specified, within the estimated time selected during checkout, and in any case within a maximum of thirty days from order confirmation.

  4. If delivery is not possible, the order will be sent to a depot. In such cases, a notice will specify the depot location and how to arrange a new delivery.

  5. If the user is unable to be present at the delivery location at the agreed time, they must contact GLS directly.

  6. If delivery cannot occur due to reasons beyond our control after thirty days from when the order is available for delivery, we will assume the contract is to be terminated.

  7. Following termination, the amounts paid will be refunded, including delivery costs (excluding any additional charges due to a different delivery method), without undue delay and in any case within 14 days of contract termination. The return transport may incur additional costs, borne by the buyer.

  8. Shipping costs are borne by the buyer and are explicitly stated at the time of ordering.

Art. 9 - Right of Withdrawal

  1. The right of withdrawal applies only to products covered by Legislative Decree No. 206 of September 6, 2005 (Consumer Code).

  2. The buyer may cancel the concluded contract without penalty and without giving any reason within 14 (fourteen) days from the receipt of the ordered goods. Within this period, the customer must notify their intention to withdraw by emailing opticallucca@gmail.com or calling +39 0583 491847. The goods must be returned to the address provided via email.

  3. Regarding the return terms, procedures, costs, and all related aspects, the provisions of the aforementioned Legislative Decree No. 206/2005 apply.

  4. If the goods are not intact, the purchase amount will not be refunded.

Art. 10 - Communications

  1. Except as expressly stated or required by law, communications between the seller and the buyer will preferably occur via email sent to the respective addresses, which both parties agree shall be valid means of communication and admissible in legal proceedings as electronic documents.

  2. Each party may change its email address for these purposes at any time, provided that prompt notice is given to the other party as described above.

Art. 11 - Withdrawal

  1. In accordance with applicable laws, the buyer has the right to withdraw from the purchase without penalty and without providing a reason, within 14 days pursuant to Article 57 of Legislative Decree 206/2005, starting from the date the products are received.

  2. For multiple items ordered in a single order but delivered separately, the 30-day period starts from the date of receipt of the last product.

  3. To exercise the right of withdrawal, the user may send an email with the order number and name to: opticallucca@gmail.com

  4. The buyer may also withdraw by sending any explicit statement expressing the decision to withdraw or by submitting the standard withdrawal form (Annex I, Part B, Legislative Decree 21/2014, not mandatory).

  5. Goods must be returned to the address communicated via email.

  6. Returned goods must be intact, in the original packaging, complete in all parts, and accompanied by the relevant tax documentation. Subject to the right to verify compliance, the site will refund the product amount within 14 days, excluding any shipping costs borne by the user.

  7. Return shipping costs are borne by the user.

  8. As per Article 56(3) of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the refund may be withheld until the goods are received or proof of return is provided.

  9. The right of withdrawal does not apply if the services or products of OPTICAL LUCCA fall under the categories of Article 59 of Legislative Decree 206/2005.

  10. The refund will be made using the same payment method selected by the buyer during purchase. In the case of payment by bank transfer, the user must provide IBAN, SWIFT, and BIC codes for the refund.

Art. 12 - Data Processing

  1. The buyer’s data is processed in accordance with the relevant data protection laws, as specified in the Privacy Policy pursuant to Article 13 of EU Regulation 2016/679.

Art. 13 - Severability Clause

  1. If any clause of these General Terms and Conditions of Sale is found to be invalid for any reason, this shall not affect the validity and enforceability of the remaining provisions.

Art. 15 - Governing Law and Jurisdiction

  1. These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, without prejudice to any mandatory consumer protection law in the buyer’s country of habitual residence. Consequently, interpretation, execution, and termination of the Terms are subject exclusively to Italian law.

  2. Any disputes relating to or arising from these Terms shall be subject to the exclusive jurisdiction of the Italian courts. If the user is a consumer, the dispute shall be resolved by the court of the place of residence or domicile of the consumer, in accordance with applicable law.
